Terms of Service

1. Introduction and Acceptance

These Terms of Service govern your access to and use of the website, communications, estimates, scheduling tools, roofing consultations, and related services offered by SummitShield Roofing. By visiting our website, requesting an estimate, submitting information, approving a proposal, scheduling an appointment, or otherwise using our services, you agree to these Terms. If you do not agree, you should not use our website or services.

SummitShield Roofing provides residential and commercial roofing-related services, which may include roof inspections, repair recommendations, replacement proposals, maintenance guidance, storm damage assessments, gutter or exterior-related coordination, and other services described in a written estimate, proposal, work order, or contract. These Terms apply generally to your use of our website and service interactions. Specific project terms, pricing, warranties, payment schedules, and scope of work may be set out in a separate written agreement. If there is a conflict between these Terms and a signed project agreement, the signed project agreement will control for that project to the extent of the conflict.

These Terms are effective as of 2026-05-22. We may update them from time to time as described below. Your continued use of our website or services after updated Terms are posted or provided constitutes your acceptance of the updated Terms.

2. About SummitShield Roofing and Our Services

SummitShield Roofing is a roofing service brand operating from 245 West 29th Street, Suite 604, New York, NY 10001, US. You may contact us at hello@summitshieldroofing.com. Our services may include information about roofing systems, inspection scheduling, estimates, repair or replacement coordination, customer support, and related communications. The exact availability of any service may depend on your location, property type, roof condition, weather, permitting requirements, material availability, insurance considerations, and other practical factors.

Information provided on our website or in preliminary communications is for general informational purposes only and does not constitute a binding quote, warranty, engineering report, insurance coverage determination, or professional opinion unless expressly stated in a signed written document by an authorized representative of SummitShield Roofing. Any estimate or recommendation may be subject to change after an in-person inspection, discovery of concealed conditions, review of building requirements, confirmation of measurements, or changes in material or labor costs.

We reserve the right to decline, postpone, or cancel services where we determine, in our reasonable judgment, that work would be unsafe, impractical, outside our service area, inconsistent with applicable law, or otherwise not appropriate. We may use employees, subcontractors, suppliers, consultants, or other third parties to support service delivery, subject to applicable agreements and legal requirements.

3. Estimates, Proposals, Scheduling, and Site Access

Requests for estimates or appointments do not guarantee that we will perform work or that a particular price, schedule, material, or service will be available. Unless otherwise stated in writing, estimates are not final contracts and may expire after the period shown on the estimate or, if no period is stated, after a reasonable time. Pricing may change due to site conditions, code requirements, permits, material price changes, structural issues, decking condition, water damage, access limitations, disposal requirements, or other factors discovered before or during work.

You are responsible for providing accurate property information, contact details, access instructions, and any known hazards, restrictions, association rules, building requirements, prior damage, leaks, or insurance claim details relevant to the requested services. You must ensure that we have safe and lawful access to the property at scheduled times. You are also responsible for securing pets, vehicles, personal belongings, fragile items, attic contents, wall decor, and other property that could be affected by vibration, debris, weather exposure, or normal construction activity.

Schedules are estimates and may be affected by weather, emergency repairs, supplier delays, permitting, inspections, labor availability, unsafe conditions, or other events outside our reasonable control. We will use commercially reasonable efforts to communicate schedule changes, but we are not responsible for losses caused by delays unless expressly required by a signed written agreement or applicable law.

4. Customer Responsibilities and Prohibited Conduct

When using our website or services, you agree to act lawfully, provide accurate information, and cooperate reasonably with our team. You may not use our website or communications channels to submit false information, impersonate another person, interfere with our systems, attempt unauthorized access, transmit malicious code, scrape content in violation of law, harass our personnel, or engage in fraudulent, abusive, or unlawful conduct.

If you request services for a property, you represent that you are the owner, authorized tenant, property manager, representative, or other person with authority to request access, inspection, or work at that property. You are responsible for obtaining any approvals required from co-owners, landlords, tenants, homeowners associations, building managers, lenders, insurers, or other parties unless a written agreement expressly assigns that responsibility to us.

You agree not to rely on visual inspections, website content, photographs, or informal communications as a substitute for a full professional assessment where one is necessary. Roofing conditions can involve concealed defects, moisture intrusion, structural deterioration, mold, electrical hazards, and other issues not visible during an initial inspection. You should promptly address active leaks, safety concerns, and structural issues and should consult appropriate specialists when needed.

5. Payments, Deposits, Change Orders, and Taxes

Payment obligations, deposit requirements, progress payments, final payment deadlines, accepted payment methods, financing terms, cancellation charges, and late fees may be described in a separate estimate, invoice, proposal, or signed project agreement. You agree to pay all amounts due in accordance with the applicable documents. Unless expressly stated otherwise, prices may not include taxes, permit fees, inspection fees, financing charges, unforeseen repairs, decking replacement, structural work, code upgrades, or additional materials and labor required due to concealed conditions.

Changes to the scope of work may require a written change order, revised estimate, email approval, or other documented authorization acceptable to SummitShield Roofing. Change orders may affect price, schedule, materials, and warranties. If emergency or safety-related conditions require immediate action, we may recommend temporary measures or additional work, but we are not obligated to perform work outside the agreed scope unless we accept the additional work in writing.

If payment is not received when due, we may suspend or cancel services, withhold warranty processing to the extent permitted by law, charge applicable late fees or collection costs if authorized by agreement or law, and pursue available remedies. You remain responsible for amounts owed even if you are awaiting insurance proceeds, financing approval, association approval, or third-party reimbursement, unless a written agreement expressly states otherwise.

6. Permits, Codes, Materials, and Work Conditions

Roofing work may be subject to building codes, permits, inspections, zoning requirements, fire ratings, manufacturer specifications, and local rules. Responsibility for permits and inspections may be specified in a written project agreement. Where we agree to handle permits, you agree to provide reasonable cooperation, signatures, documents, and access needed to complete the process. Permit or inspection delays may affect the schedule and are not always within our control.

Materials may vary in color, texture, finish, availability, and appearance. Matching existing shingles, tiles, metal, flashing, gutters, siding, or other exterior components may not be possible due to age, weathering, manufacturing variations, discontinued products, or differences in installation methods. Product substitutions may be necessary if materials are unavailable, delayed, or discontinued, and any substitution will be handled in accordance with the applicable agreement.

Roofing and exterior construction can involve noise, vibration, dust, debris, driveway use, landscaping impacts, temporary exposure to weather, and other normal construction conditions. We will use reasonable efforts to perform work professionally, but you acknowledge that construction activity may create inconvenience. You should remove or protect valuables and notify us of sensitive areas, irrigation systems, skylights, solar panels, satellite equipment, security cameras, low-voltage wiring, fragile landscaping, or other items that may require special attention.

7. Warranties and Disclaimers

Any workmanship warranty, manufacturer warranty, product warranty, maintenance requirement, limitation, exclusion, or claim procedure will be described in the applicable written project documents or manufacturer materials. Manufacturer warranties are provided by the manufacturer, not by SummitShield Roofing, unless expressly stated otherwise. Warranty coverage may be affected by improper maintenance, unauthorized repairs, storm damage, foot traffic, structural movement, ventilation issues, ice dams, clogged gutters, pests, pre-existing conditions, natural wear, acts of God, or other exclusions.

Except as expressly provided in a signed written agreement, our website, general information, preliminary assessments, and services are provided on an “as is” and “as available” basis to the fullest extent permitted by law. SummitShield Roofing disclaims all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade, to the extent such disclaimers are permitted by applicable law.

Some states do not allow limitations on implied warranties or certain disclaimers, so some limitations may not apply to you. Nothing in these Terms is intended to limit rights that cannot be limited under applicable law, including rights under state consumer protection laws or mandatory contractor regulations.

8. Insurance, Storm Damage, and Third-Party Matters

SummitShield Roofing may provide observations, photographs, measurements, or repair estimates that you may choose to share with an insurance company, property manager, lender, or other third party. We do not guarantee that an insurance claim will be approved, that a carrier will pay a particular amount, or that coverage exists under your policy. Insurance coverage decisions are made by the insurer, subject to the terms of your policy and applicable law.

You are responsible for reviewing your insurance policy, deductibles, exclusions, claim obligations, and communications with your insurer. We do not act as a public adjuster, insurance broker, attorney, or claims representative unless specifically licensed and engaged in that capacity, and nothing in our communications should be treated as legal or insurance advice. You should consult qualified professionals for advice regarding insurance coverage, legal rights, financing, tax treatment, or structural engineering issues.

If a third party is involved in payment, approval, scheduling, or project coordination, you remain responsible for ensuring that the necessary authorizations are obtained and that payment obligations are satisfied unless otherwise agreed in writing. Delays or disputes with insurers, lenders, associations, tenants, or other third parties do not automatically extend payment deadlines or alter your obligations to us.

9. Intellectual Property and Website Use

All content on our website and in our marketing materials, including text, images, graphics, logos, service descriptions, layouts, and other materials, is owned by or licensed to SummitShield Roofing and is protected by intellectual property laws. You may view and use the website for personal, non-commercial purposes related to learning about or requesting our services. You may not copy, modify, distribute, sell, reverse engineer, or exploit our website content without our prior written permission, except as allowed by law.

If you submit reviews, testimonials, photographs, comments, questions, or other content to us, you represent that you have the right to do so and that the content is accurate to the best of your knowledge and does not violate the rights of others. To the extent permitted by law, you grant SummitShield Roofing a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute content you voluntarily provide for business purposes, such as customer support, quality control, recordkeeping, and marketing, unless you and we agree otherwise in writing.

You may not post or transmit content that is unlawful, defamatory, harassing, misleading, infringing, obscene, threatening, or otherwise objectionable. We may remove or decline to use submitted content at our discretion.

10. Limitation of Liability

To the fullest extent permitted by law, SummitShield Roofing and its owners, officers, employees, contractors, suppliers, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, loss of use, loss of data, loss of goodwill, business interruption, or similar losses arising out of or related to your use of our website or services, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our total liability for claims arising out of or related to the website or general service interactions will not exceed the amount you paid to SummitShield Roofing for the specific service giving rise to the claim, or, if no amount was paid, one hundred U.S. dollars. For contracted roofing projects, any liability limitations, remedies, warranty terms, or claim procedures in the signed project agreement will apply to the extent permitted by law.

These limitations do not apply to liability that cannot be limited under applicable law, such as liability for certain intentional misconduct, gross negligence where not waivable, or other non-waivable statutory rights. Because some states do not allow the exclusion or limitation of certain damages, some limitations may not apply to you.

11. Indemnification

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless SummitShield Roofing and its owners, officers, employees, contractors, suppliers, and agents from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of our website, your violation of these Terms, your violation of applicable law, your submission of inaccurate information, your lack of authority to request services at a property, or your infringement or misappropriation of any rights of another person.

This indemnification obligation does not require you to indemnify us for our own negligence or misconduct to the extent such indemnification is prohibited by applicable law. We reserve the right to control the defense of any matter subject to indemnification, and you agree to cooperate reasonably with our defense.

12. Disputes, Governing Law, and Changes to These Terms

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles, except to the extent applicable consumer protection, contractor, or other mandatory laws provide otherwise. Any dispute arising out of or related to these Terms, our website, or our services will be handled in the state or federal courts located in New York County, New York, unless a different forum is required by applicable law or a signed project agreement provides a different dispute resolution process.

Before filing a claim, you agree to contact us at hello@summitshieldroofing.com and provide a reasonable description of the issue so that we can attempt to resolve it informally. This informal process does not limit either party’s right to seek urgent injunctive relief or to comply with applicable deadlines. Any claim must be brought within the time period required by applicable law or by the applicable written agreement.

We may update these Terms at any time by posting a revised version on our website or otherwise providing notice where appropriate. The updated Terms will be effective as of the date stated in the revised version. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later.
